The central feature to this biography is the expert's complete understanding of the overarching relationships that exist between health [[[[care]]]] , medical [[[[care]]]] , hospital policies, medical staff bylaws and health [[[[care]]]] regulations – as they relate to litigation proceedings.
The core foundation to these relationships is to understand that health [[[[care]]]] and medical [[[[care]]]] are not the same. Health [[[[care]]]] is offered by a hospital to members of their community and is supported by the medical [[[[care]]]] provided only by licensed physicians. There are both joint and separate regulations for health and medical [[[[care]]]] . And many interweaving linkages exist between these clinical interventions. Neither [[[[care]]]] can be successful without the other. Yet, while they are not technically the same -- they are never independent of each other. And more often than not, the facts of a legal matter very often relate to and are supported by, the regulatory statues and the hospital’s published policies, procedures and bylaws in effect at the time of a patient incident.
JCAHO, CMS and State regulatory statutes are written and enforced throughout our nation for the sole purpose of establishing irrefutable guidelines on which hospitals and physicians must deliver safe and effective [[[[care]]]] . All hospitals and practitioners are ethically and legally bound to exert all efforts to comply with all accreditation and regulatory standards as they apply to the health and medical services they provide.
The assessment, planning, testing, coordination and delivery activities that comprise health [[[[care]]]] and all medical procedures are to be collaborative across the [[[[care]]]] continuum. All disciplines are involved and thus all contribute, to some degree, in the delivery and outcome of [[[[care]]]] – or in the consequences of patient injury. The [[[[care]]]] and service policies and working procedures of a hospital are to be designed and carried out across department lines.
Rarely do physicians perform medical procedures, delivery medical [[[[care]]]] or commit unplanned errors alone. However unplanned health [[[[care]]]] errors and injuries can occur without the knowledge or involvement of a physician.
Scope of Services:
Support litigation efforts on behalf of the plaintiff
Support litigation efforts on behalf of the defense
Execute in-depth analysis of background, hospital and record documentation of policies, procedures, bylaws, service contracts, staff hiring and performance evidence, credentialing procedures and regulatory guidelines relative to the legal proceeding.
Generate summary analysis reports and render expert opinions
Assist with trial preparation and provide deposition, research and testimony
Patient Safety Improvement initiatives to improve interdisciplinary processes and reduce avoidable patient harm, injury and death.
JCAHO, CMS and State regulations which guide and serve to enforce the rules and principles of the health [[[[care]]]] industry. Regulatory compliance is achieved through the establishment of required policies, procedures, staff performance, interdisciplinary collaborative [[[[care]]]] (MD’s – RN’s – Techs – Administrative staff), and performance measurement procedures.
Human Resource hiring, credentials, competence, performance evaluation and Temp Agency hiring and utilization conflicts. Regulatory and/or policy compliance can only be achieved through targeted human resources programs.
