ACCIDENT INVESTIGATION

Accidents occur when hazards escape detection during preventive measures, such as a job or process safety analysis, when hazards are not obvious, or as the result of combinations of circumstances that were difficult to foresee. A thorough accident investigation may identify previously overlooked physical, environmental, or process hazards, the need for new or more extensive safety training, or unsafe work practices. The primary focus of any accident investigation should be the determination of the facts surrounding the incident and the lessons that can be learned to prevent future similar occurrences.

Firms in the advertising and public relations services industry prepare advertisements for other companies and organizations and design campaigns to promote the interests and image of their clients. This industry also includes media representatives—firms that sell advertising space for publications, radio, television, and the Internet; display advertisers—businesses engaged in creating and designing public display ads for use in shopping malls, on billboards, or in similar media; and direct mail advertisers. A firm that purchases advertising time (or space) from media outlets, thereafter reselling it to advertising agencies or individual companies directly, is considered a media buying agency. Divisions of companies that produce and place their own advertising are not considered part of this industry.

AFFILIATE MARKETING

Affiliate Marketing is a popular method of promoting web businesses in which an affiliate is rewarded for every visitor, subscriber and/or customer provided through his efforts. It is a modern variation of the practice of paying finder's-fees for the introduction of new clients to a business. Compensation may be made based on a certain value for each visit (Pay per click), registrant (Pay per lead), or a commission for each customer or sale (Pay per Sale), or any combination.

AFFIRMATIVE ACTION

Affirmative action (U.S. English), or positive discrimination (British English), is a policy or a program aimed at increasing the representation of members of groups that have traditionally been discriminated against. This typically focuses on education, employment, government contracting, health care, or social welfare.

AMBIT ENERGY

Multi-level marketing (MLM) (also called network marketing or NM) is a business model that combines direct marketing with franchising. In a typical multi-level marketing or network marketing arrangement, individuals associate with a parent company as an independent contractor and are compensated based on their sales of products or service (as well as the sales achieved by those they bring into the business). In a legitimate MLM company, commissions are earned only on sales to the end-user, who is often also a distributor. No money may be earned from recruiting alone ("sign-up fees"). Some companies produce revenues primarily by attracting new participants or selling them marketing services, as opposed to selling actual products. One must analyze the compensation plan to determine whether participants are paid from actual sales to customers and not from new-recruit bonuses or business support sales. Multi-level marketing has a recognized image problem due to the fact that it is often difficult to distinguish legitimate MLMs from such illegal scams as pyramid or Ponzi schemes. NM/MLM businesses do operate legitimately in all 50 U.S. states and more than 100 other countries, and new businesses may use terms like "affiliate marketing" or "home-based business franchising."

ARBITRATION / MEDIATION

Arbitration is a form of mediation or conciliation, where the mediating party is given power by the disputant parties to settle the dispute by making a finding. In practice arbitration is generally used as a substitute for judicial systems, particularly when the judicial processes are viewed as too slow, expensive or biased. Arbitration is also used by communities which lack formal law, as a substitute for formal law. Mediation consists of a process of alternative dispute resolution in which a (generally) neutral third party, the mediator, using appropriate techniques, assists two or more parties to help them negotiate an agreement, with concrete effects, on a matter of common interest. More generally speaking, the term "mediation" covers any activity in which an impartial third party (often a professional) facilitates an agreement on any matter in the common interest of the parties involved.

ASBESTOS

Asbestos (a misapplication of Latin: asbestos "quicklime" from Greek ἄσβεστος: a-, "not"; sbestos, "extinguishable") describes any of a group of fibrous metamorphic minerals of the hydrous magnesium silicate variety. The name is derived for its historical use in lamp wicks; the resistance of asbestos to fire has long been exploited for a variety of purposes. It was used in fabrics such as Egyptian burial cloths and Charlemagne's tablecloth, which, according to legend, he threw in a fire to clean. Asbestos occurs naturally in many forms (see below); it is mined from metamorphic deposits.

AUTOMOBILE ACCIDENT

Car accidents are damaging events involving road traffic, particularly automobiles. They can cause damage to vehicles, people or structures. Car accidents — also called traffic collisions, auto accidents, road accidents, personal injury collisions, motor vehicle accidents, and (particularly by American radio traffic reporters) crashes — kill an estimated 1.2 million people worldwide each year, and injure about forty times this number (WHO, 2004). The term "accident" is considered inappropriate by some, as reliable sources estimate that upwards of 90% are the result of driver negligence.

AUTOPSIES

An autopsy, also known as a post-mortem examination or an obduction, is a medical procedure that consists of a thorough examination of a corpse to determine the cause and manner of a persons death and to evaluate any disease or injury that may be present. It is usually performed by a specialized medical doctor called a pathologist.

BANK COMPLIANCE

Compliance requirements are a series of directives established by United States federal government agencies that summarize hundreds of federal laws and regulations applicable to Federal assistance. Bank regulations are a form of government regulation which subject banks to certain requirements, restrictions and guidelines, aiming to uphold the soundness and integrity of the financial system. A bank is an institution that provides financial service, particularly taking deposits and extending credit.

BICYCLE HELMETS

A bicycle helmet is designed to provide head protection for cyclists. Helmets are most suitable for preventing injury in straight falls, and for reducing friction related damage to the head. Modern bicycle helmets were first developed in the 1970s.

BIRTH INJURY

Occasionally during the birth process, the baby may suffer a physical injury that is simply the result of being born. This is sometimes called birth trauma or birth injury. 1 in 200 babies is born with some form of birth injury, and many of these cases may have been caused by medical negligence.

BREACH OF CONTRACT

Breach of contract is a legal concept in which a binding agreement or bargained-for exchange is not honored by one or more of the parties to the contract by non-performance or interference with the other partys performance.

BUILDING CODE

A building code is a set of laws that specify how buildings should be constructed. This is generally considered the minimum acceptable level of safety for a new building in a jurisdiction. Building codes are generally intended to be applied by architects and engineers. There are often other codes or sections of the building code that have more prescriptive requirements that apply to housing (one and two family dwellings).

BUS ACCIDENT

A bus is a large, motorized, wheeled vehicle intended to carry numerous persons in addition to the driver. The name is a shortened version of omnibus, which means for everyone.

CEREBRAL PALSY

Cerebral palsy

is a term used to describe a group of chronic conditions affecting body movements and muscle coordination. It is caused by damage to one or more specific areas of the brain, usually occurring during fetal development, or during infancy. It can also occur before, during or shortly following birth. "Cerebral" refers to the brain and "Palsy" to a disorder of movement or posture.

CHECK KITING

Check kiting is any sort of fraud that involves drawing out money from a bank account that does not have sufficient funds to cover the check. It is typically achieved by taking advantage of the float, the time between the negotiation of the check and its clearance at the check-writer's bank. This fraud is also known as paper hanging and carries a heavier pejorative connotation. Before the passage of the Check Clearing for the 21st Century Act, when checks could take 3 or more days to clear, playing the float was fairly common practice in otherwise-honest low-income families who encountered emergencies right before payday.

CLAIMS

A claim is a legal action to obtain money, property or the enforcement of a right protected by law against another party.

Individuals and businesses purchase insurance policies to protect against monetary losses. In the event of a loss, policyholders submit claims, or requests for payment, seeking compensation for their loss. Adjusters, appraisers, examiners, and investigators work primarily for property and casualty insurance companies, for whom they handle a wide variety of claims alleging property damage, liability, or bodily injury. Their main role is to investigate the claims, negotiate settlements, and authorize payments to claimants, all the while mindful not to violate the claimant’s rights under Federal and State privacy laws. They must determine whether the customer’s insurance policy covers the loss and how much of the loss should be paid to the claimant. Although many adjusters, appraisers, examiners, and investigators have overlapping functions and may even perform the same job, the insurance industry generally assigns specific roles to each of these claims workers.

CLASS ACTION MANAGEMENT (FOREIGN and DOMESTIC)

In law, the class action is a procedural device used in litigation to determine the rights of and remedies, if any, for large numbers of people whose cases involve common questions of law and fact

COMPENSATION / WAGES / SALARY

The compensation of every employee is decided by the company owners through the board of directors (in the case of the most highly compensated executive positions) and the management team (or "management committee") (for everyone else). The board of directors may have a personnel and compensation committee that deals specifically with labor compensation.

CONTRACT & MISC. SURETY

A surety is a person who agrees to be responsible for the debt or obligation of another. The situation in which a surety is most typically required is when the ability of the primary obligor or principal to perform its obligations under a contract is in question, or when there is some public or private interest which requires protection from the consequences of the principal's default or delinquency. In most common law jurisdictions, a contract of suretyship is subject to the statute of frauds (or its equivalent local laws) and is only enforceable if memorialized by a writing signed by the surety.

A surety bond is a contract between at least three parties: (i) the principal, (ii) the obligee, and (iii) the surety. Through this agreement, the surety agrees to make the obligee whole (usually by payment of money) if the principal defaults in its performance of its promise to the obligee. The contract is formed so as to induce the obligee to contract with the principal, i.e., to demonstrate the credibility of the principal.

CONTRACTS - INTERPRETATION

A contract is a promis or an agreement that is enforced or recognized by the law. In the civil law, contracts are considered to be part of the general law of obligations. This article describes the law relating to contracts in common law jurisdictions.

Contract theory comprises many different theories and various interpretations of the various body of rules and subrules that define Contract Law.

Classical contract theory is the set of ideas and assumptions that underpinned the development of contract law in England and the United States during the 19th century. During this period, the prevailing liberal individualist philosophy of laissez faire elevated contract to a position of central importance in the law.

COOLING TOWERS

Cooling towers are structures for cooling water or other working medium to near-ambient temperature. The primary use of large, industrial cooling towers is to lower the temperature of the cooling water used in power plants, petroleum refineries, petrochemical plants, natural gas processing plants and other industrial facilities. It is desirable to cool the water rather than simply discharging it because the cooling water is typically demineralized and it is cheaper to cool it rather than getting more demineralized water. Furthermore, discharging large amounts of hot water may raise the temperature of the receiving river or lake to an unacceptable level for the local ecosystem. A cooling tower serves to dissipate the heat into the atmosphere instead and wind and air diffusion spreads the heat over a much larger area than hot water can distribute heat in a body of water.

DAMAGES

In law, damages refers either to the harm suffered by a claimant in a civil action, or to the money paid or awarded to the plaintiff in compensation for such harm. Generally, there are three kinds of damages: special damages, general damages, and punitive damages. Special damages are the enumerable or quantifiable monetary costs or losses suffered by the plaintiff, or the compensation therefore. For example, medical costs, repair or replacement of damaged property, lost wages, lost earning potential, loss of business, loss of irreplaceable items, loss of support, etc. General damages are items of harm or loss suffered, for which only a subjective value may be attached. Examples of this include personal injury, physical or emotional pain and suffering, loss of companionship, loss of consortium, disfigurement, loss of reputation, loss or impairment of mental or physical capacity, loss of enjoyment of life, etc.

DEATH PENALTY

Capital punishment, or the death penalty, is governmental killing by execution as punishment for a crime often called a capital offense or a capital crime. Historically, the execution of criminals and political opponents was used by nearly all societies either by means of judicial process or through political motivations such as the supression of political dissent. Among democratic countries around the world, most European and Latin American ones have abolished capital punishment (except the United States, Guatemala and most of the Caribbean), while democracies in Asia and Africa retain it. Among nondemocratic countries the use of the death penalty is common.

DEFAMATION

In English and American law, and systems based on them, libel and slander are two forms of defamation (or defamation of character), which is the tort or delict of publishing (meaning to a third party) a false statement that negatively affects someone's reputation. "Defamation" is the term generally used internationally, and is accordingly used in this article where it is not necessary to distinguish between "libel" and "slander".

DOORS AND GATES

A door is a generally floor-length opening in a wall (or other partition), often equipped with a hinged or sliding panel which can be moved to leave the opening accessible, or to close it more or less securely. Doors are nearly universal in structures of all kinds (especially houses and other buildings), allowing passage between inside and outside, or among internal rooms. Doors are also found in vehicles, cupboards, cages, etc. A gate is a point of entry to a space enclosed by walls, or an opening in a fence. Gates may prevent or control entry or exit, or they may be merely decorative.

DROWNING

Drowning is death caused by the filling of the lungs by a liquid, usually water, rendering breathing ineffective and leading to death due to asphyxia. Near drowning is initial survival of a drowning event, and can lead to serious secondary complications including death later on; cases of near drowning therefore also require attention by medical professionals. Secondary drowning is death due to chemical and biological changes in the lungs after a near drowning incident or exposure to chemicals. In many countries, drowning is one of the leading causes of death for children under 14 years old.

DUMBWAITER

A small elevator used to transport food or other items between floors of a building. An elevator is a transport device used to move goods or people vertically. Outside North America, elevators are known more commonly as lifts, although the word elevator is familiar from American movies and television shows, just as some Americans are aware of lift from imported entertainment. Other languages may have loanwords based on either elevator (e.g. Japanese) or lift (e.g. Cantonese). Because of wheelchair access laws, elevators are often a requirement in new buildings with multiple floors.

EMERGENCY MEDICAL SYSTEMS

The Emergency Medical Service system (known by the acronym "EMS" in the USA and Canada) is responsible for providing pre-hospital (or out-of-hospital) care by paramedics, emergency medical technicians (EMT's), and medical first responders (MFRs in US terminology). The goal of EMS is to provide early treatment to those in need of urgent medical care, and ultimately rapid transportation to an Emergency department. Stabilizing patients early (within the golden hour) significantly increases their chances of survival, particularly in the event of a heart attack, diabetic emergency, or severe physical trauma.

ERGONOMICS

Ergonomics (or human factors) is the scientific discipline concerned with the understanding of interactions among humans and other elements of a system, and the profession that applies theory, principles, data, and methods to design in order to optimize human well-being and overall system performance (definition adopted by the International Ergonomics Association in 2000).

FIDUCIARY DUTIES

The fiduciary duty is a legal relationship between two or more parties, most commonly a "fiduciary" or "trustee" and a "principal" or "beneficiary", that in English common law is arguably the most important concept within the portion of the legal system known as equity. Since the Judicature Acts merged the courts of Equity (historically based in England's Court of Chancery) with the courts of common law, the concept of fiduciary duty also became usable in common law courts.

FORKLIFTS - FORK LIFTS TRUCKS

A forklift truck (often just called forklift) is a powered industrial truck used to lift and transport materials by means of steel forks inserted under the load. The forklift was developed in the 1920s by various companies including the transmission manufacturing company Clark (today known as Clark Material Handling Company) and the hoist company Yale & Towne Manufacturing (Today known as Yale Materials Handling Corporation)[1]. It has since become an indispensable piece of equipment in many manufacturing and warehousing operations. A different type of forklift is the sideloader (i.e Fiora sideloader)[2], usually designed to transport long loads in very narrow aisle (VNA trucks).

GENERAL PRACTICE

A general practitioner (GP) or family physician (FP) is a physician/medical doctor who provides primary care. A GP/FP treats acute and chronic illnesses, provides preventive care and health education for all ages and both sexes. Some also care for hospitalized patients, do minor surgery and/or obstetrics. The term general practitioner is common in the United Kingdom, where the word "physician" is only used for certain specialists and not for GPs.

HELICOPTERS

A helicopter is an aircraft which is lifted and propelled by one or more horizontal rotors (propellers). Helicopters are classified as rotary-wing aircraft to distinguish them from conventional fixed-wing aircraft. The word helicopter is derived from the Greek words helix (spiral) and pteron (wing). The engine-driven helicopter was invented by the Slovak inventor Jan Bahyl. The first stable, single-rotor, fully-controllable helicopter to enter large full-scale production was made by Igor Sikorsky in 1942.

HUMAN RESOURCES

Human resources has at least two meanings depending on context. The original usage derives from political economy and economics, where it was traditionally called labor, one of three factors of production. The more common usage within corporations and businesses refers to the individuals within the firm, and to the portion of the firm's organization that deals with hiring, firing, training, and other personnel issues. This article will address both definitions.

HVAC - HEAT VENTITATION AIR CONDITIONING

HVAC (pronounced either "H-V-A-C" or, occasionally, "H-VAK") is an initialism/acronym that stands for "heating, ventilation and air-conditioning". This is sometimes referred to as climate control. These three functions are closely interrelated, as they control the temperature and humidity of the air within a building in addition to providing for smoke control, maintaining pressure relationships between spaces, and providing fresh air for occupants. In modern building designs, the design, installation and control systems of these functions are integrated into a single "HVAC" system. The term air handler can mean a whole unit including the blower, heating and cooling elements, filter racks or chamber and dampers, but not including the ductwork through the building.

HYDROLOGY

Hydrology (from Greek: Yδρoλoγια, Yδωρ+Λoγos, Hydrologia, the "study of water") is the study of the movement, distribution, and quality of water throughout the Earth, and thus addresses both the hydrologic cycle and water resources. A practitioner of hydrology is a hydrologist, working within the fields of either earth or environmental science, or civil and environmental engineering.

IME - INDEPENDENT MEDICAL EXAMINER

When this examiner is hired by the defendant, the medical professional will look for other possible causes of any personal injury alleged. Industrial Hygienist An expert witness who provides opinion testimony concerning the collection, sampling and analysis of toxic mold and other environmental contaminants.

INDUSTRIAL VENTILATION

Ventilation is movement of air, typically between an indoor space and the outside. When people or animals are present, ventilation is especially necessary to evacuate the carbon dioxide produced and renew the oxygen used up. It is also needed to remove other pollutants (smoke, chemicals, etc.) from the space. Ventilation air can also be used to heat, cool, humidify and dehumidify the space and to filter particles or contaminants from the air.

INSURANCE - AUTO

Vehicle insurance (or Auto insurance, car insurance, motor insurance) is insurance consumers can purchase for cars, trucks, and other vehicles. Its primary use is to provide protection against losses incurred as a result of traffic accidents.

INSURANCE FRAUD

Insurance fraud or false insurance claims are insurance claims filed with the intent to defraud an insurance provider. In the United States insurance fraud is estimated to cost US$875 per person per year with The Coalition Against Insurance Fraud estimating the loss to be $80 billion per year and Medicare estimating fraud in its system costs the government $179 billion per year. Insurance fraud hurts the average person in two ways. First, all fraud costs, including losses, investigations, etc., are paid for by the insured through higher premiums, or, in the case of government insurance like Medicare, in higher taxes. Second, if a particular individual is the target for the fraud, they have costs such as deductible payments, loss of property use, etc., as well as higher premiums from the claim loss and the potential for denial of future coverage.

INSURANCE - GENERAL

General insurance policies, including automobile and homeowners policies, provide payments depending on the loss from a particular financial event. General insurance typically comprises any insurance that is not determined to be life insurance, and is called property and casualty insurance in the U.S..

In the UK, General insurance is broadly divided into three areas; personal lines, commercial lines and London market.

The London market insures with large commercial risks, for example insuring supermarkets, football players and other very specific risks.

Commercial lines products are usually designed for relatively small legal entities. These would include workers comp (employers liability), public liability, product liability, commercial fleet and other general insurance products sold in a relatively standard fashion to many organisations.

Personal lines products are designed to be sold in large quantities. This would include autos (private car), homeowners (household), pet insurance, creditor insurance and others.

INSURANCE - PERSONAL INJURY PROTECTION (PIP)

INVESTMENT BANKING

Investment banks assist public and private corporations in raising funds in the capital markets (both equity and debt), as well as in providing strategic advisory services for mergers, acquisitions and other types of financial transactions. They also act as intermediaries in trading for clients. Investment banks differ from commercial banks, which take deposits and make commercial and retail loans. In recent years, however, the lines between the two types of structures have blurred, especially as commercial banks have offered more investment banking services. In the US, the Glass-Steagall Act, initially created in the wake of the Stock Market Crash of 1929, prohibited banks from both accepting deposits and underwriting securities; Glass-Steagall was repealed by the Gramm-Leach-Bliley Act in 1998. Investment banks may also differ from brokerages, which in general assist in the purchase and sale of stocks, bonds, and mutual funds. However some firms operate as both brokerages and investment banks; this includes some of the best known financial services firms in the world.

LAND USE PLANNING & ZONING

Land Use Planning is the term used for a branch of public policy which encompasses various disciplines which seek to order and regulate the use of land in an efficient way. Despite confusing nomenclature, the essential function of planning remains the same whatever term is applied. The Canadian Planners Association offers a definition that; "[Land Use] Planning means the scientific, aesthetic, and orderly disposition of land, resources, facilities and services with a view to securing the physical, economic and social efficiency, health and well-being of urban and rural communities" Zoning is a North American term for a system of land-use regulation. The word is derived from the practice of designating permitted uses of land based on mapped zones which separate one part of a community from another. Zoning regulations fall under the police power rights governments may exercise over real property. Theoretically, its primary purpose is to segregate uses that are thought to be incompatible; in practice, zoning is used as a permitting system to prevent new development from harming existing residents or businesses. Zoning is commonly controlled by local governments such as counties or municipalities.

LIBEL

In English and American law, and systems based on them, libel and slander are two forms of defamation (or defamation of character), which is the tort or delict of publishing (meaning to a third party) a false statement that negatively affects someone's reputation. "Defamation" is the term generally used internationally, and is accordingly used in this article where it is not necessary to distinguish between "libel" and "slander".

MALPRACTICE, MEDICAL

The basic definition of medical malpractice is an act or omission by a health care provider which deviates from accepted standards of practice in the medical community and causes injury to the patient. The word malpractice has a connotation of greater culpability than negligence. In the United States and other countries, a specific medical malpractice law has developed. In English law, the issue of liability is a subset of professional negligence where, under the Bolam Test, a doctor will be liable unless shown to have acted in accordance with a reasonable body of medical opinion.

MARITAL DISSOLUTION - DIVORCE

METEOROLOGY

Meteorology is the scientific study of the atmosphere that focuses on weather processes and forecasting. Meteorological phenomena are observable weather events which illuminate and are explained by the science of meteorology. Those events are bound by the variables that exist in Earth's atmosphere. They are temperature, pressure, water vapor, and the gradients and interactions of each variable, and how they change in time. The majority of Earth's observed weather is located in the troposphere.

MOTORCYCLE HELMETS

A motorcycle helmet is a type of protective headgear used by motorcycle riders. The primary goal of a motorcycle helmet is to protect the rider's head during impact, although many helmets provide additional conveniences, such as face shields, ear protection, intercom etc.

MULTILEVEL MARKETING

NETWORK MARKETING

The term network marketing is used in two ways. In popular usage it is a synonym for multi-level marketing and often mistakenly considered the same as a pyramid scheme. The concept of "network marketing" is often used to describe a marketing paradigm that stresses the interconnectedness of market actors and transactions and can be viewed as the application of systems thinking to marketing. According to network marketing theory other marketing paradigms see the discipline as consisting primarily of dyadic relationships (ie., one buyer and one seller). Network marketing wishes to overcome this limitation by looking at transactions and relationships from the viewpoint of all those involved.

OBSTETRICS

Obstetrics is the surgical specialty dealing with the care of a woman and her offspring during pregnancy, childbirth and the puerperium (the period shortly after birth). Almost all modern obstetricians are also gynaecologists; see Obstetrics and gynaecology.

ORGAN TRANSPLANT

An organ transplant is the transplantation of a whole or partial organ from one body to another (or from a donor site on the patient's own body), for the purpose of replacing the recipient's damaged or failing organ with a working one from the donor site. Organ donors can be living, or deceased (previously referred to as cadaveric).

ORTHOTICS

Orthotics is the medical field concerned with the application and manufacture of orthoses, devices which support or correct the function of a limb or the torso. The term is derived from the Greek "ortho", to straighten. Sciences such as materials engineering, gait analysis, anatomy and physiology, and psychology contribute to the work done by orthotists, the professionals engaged in the field or orthotics. Individuals who benefit from an orthosis have sustained a physical impairment such as a stroke, spinal cord injury, or a congenital abnormality such as spina bifida or cerebral palsy.

PTSD - POST TRAUMATIC STRESS DISORDER

Post-traumatic stress disorder (PTSD) is a term for certain psychological consequences of exposure to, or confrontation with, stressful experiences that the person experiences as highly traumatic. [1] These experiences can involve actual or threatened death, serious physical injury, or a threat to physical and/or psychological integrity. It is occasionally called post-traumatic stress reaction to emphasize that it is a routine result of traumatic experience rather than a manifestation of a pre-existing psychological weakness on the part of the patient.

QME - QUALIFIED MEDICAL EVALUATOR Q.M.E.

Qualified Medical Evaluators (QME's) examine employees for workers compensation injury claims, and make evaluations of disability upon which Workers Compensation Appeals Board decisions may be based. In most cases, for unrepresented employees, the reports of a QME and of treating physicians are the only medical evaluations used in determining disability.

RADIOLOGY

Radiology is the medical specialty that utilizes and interprets imaging technologies to diagnose disease. Traditionally it was the branch of medical science dealing with the medical use of X-rays emitted by X-ray machines or other such radiation devices for the purpose of obtaining visual information as part of medical imaging. Radiologists now also use all other imaging technologies (such as ultrasound, computed tomography (CT) and magnetic resonance imaging) to diagnose or treat disease. Interventional radiology is the performance of (usually minimally invasive) medical procedures with the help of medical imaging.

REAL ESTATE BROKER / AGENT

A real estate broker is a party who acts as an intermediary between sellers and buyers of real estate and attempts to find sellers who wish to sell and buyers who wish to buy. In the United States, the relationship was originally established by reference to the English common law of agency with the broker having a fiduciary relationship with his clients. Estate agent is the term used in the United Kingdom to describe a person or organization whose business is to market real estate on behalf of clients.

In the US, real estate brokers and their salespersons (commonly called real estate agents) assist sellers in marketing their property and selling it for the highest possible price under the best terms. When acting as a Buyers agent with a signed agreement, they assist buyers by helping them purchase property for the best possible price under the best terms. Due to the importance of this role, most brokers that seek to play the role of client advocate are now seeking out the services of Certified Mortgage Planners, industry experts that work in concert with Certified Financial Planners to align consumers' home finance positions with their larger financial portfolio(s). Without an agreement, brokers may assist buyers in the acquisition of property but still represent the seller and the seller's interests.

In most jurisdictions in the United States, a person is required to have a license in order to receive remuneration for services rendered as a real estate broker. Unlicenced activity is illegal, but buyers and sellers acting as principals in the sale or purchase of real estate are not required to be licenced. In some states, lawyers are allowed to handle real estate sales for compensation without being licenced as brokers or agents.

REINSURANCE

SCHOOL PLAYGROUND SAFETY

The sports safety field of expertise encompasses the broad application of appropriate risk management concepts to try and prevent injury to the participants and fans. Risk management is the systematic application of policies, procedures and practices to the tasks of establishing the context, identifying, analysing, evaluating, treating, monitoring and communicating risk. Safety is generally interpreted as implying a real and significant impact on risk of death, injury or damage to property. In response to perceived risks many interventions may be proposed with engineering responses and regulation being two of the most common. Probably the most common individual response to perceived safety issues is insurance, which compensates for or provides restitution in the case of damage or loss. Safety engineering is an applied science strongly related to systems engineering and the subset System Safety Engineering. Safety engineering assures that a life-critical system behaves as needed even when pieces fail. In the real world the term "safety engineering" refers to any act of accident prevention by a person qualified in the field. Safety engineering is often reactionary to adverse events, also described as "incidents", as reflected in accident statistics. This arises largely because of the complexity and difficulty of collecting and analysing data on "near misses".

SURVEYS / OPINION RESEARCH

Statistical surveys are used to collect quantitative information in many fields including political polling and government, health, social science and marketing research. A survey may focus on opinions or factual information depending on its purpose, but all surveys involve administering questions to individuals. When the questions are administered by a researcher, the survey is called a structured interview or a researcher administered survey. When the questions are

TORT LAWSUITS

In the common law, a tort is a civil wrong, other than a breach of contract, for which the law provides a remedy. The origins of the modern law of torts lie in the old remedies of trespass and trespass on the case. The term itself comes from Law French and means, literally, "a wrong". In the French language, the phrase avoir tort translates to "to be wrong". The equivalent body of law in civil law legal systems is delict. A tort is a breach of a non-contractual duty potentially owed to the entire world, imposed by law. The majority of legal claims are brought in tort.

TRANSFER PRICING

Transfer pricing refers to the pricing of goods and services within a multi-divisional organization, particularly in regard to cross-border transactions. For example, goods from the production division may be sold to the marketing division, or goods from a parent company may be sold to a foreign subsidiary, with the choice of the transfer price affecting the division of the total profit among the parts of the company. This has led to the rise of transfer pricing regulations as governments seek to stem the flow of taxation revenue overseas, making the issue one of great importance for multinational corporations.

UNDERGROUND STORAGE TANK

An Underground Storage Tank (UST) is a tank and any underground piping connected to the tank that has at least ten percent of its combined volume underground. UST's used to store petroleum are regulated in the United States to a release, which could create groundwater and soil contamination. When fissures or holes occur in the underground tank, is is then called a Leaking Underground Storage Tank (LUST)

WORKERS COMPENSATION

Workers compensation systems (workers comp or compo) provide for financial compensation for work-related injuries of employees, in particular compensation of loss of wages, sometimes also for medical costs. These laws are usually a feature of highly developed industrial societies. Employees compensation laws are often only implemented after long and hard fought struggles by trade unions, particularly in early industrialisation. There are often benefits available to dependents of workers killed on the job as well.

WRONGFUL TERMINATION

Wrongful dismissal, also called wrongful termination or wrongful discharge, is an idiom and legal phrase, describing a situation in which an employees contract of employment has been terminated by the employer in circumstances where the termination breaches one or more terms of the contract of employment, or a statute provision in employment law. It follows that the scope for wrongful dismissal varies according to the terms of the employment contract, and varies by jurisdiction. Note that the absence of a formal contract of employment does not preclude wrongful dismissal in jurisdictions in which a de facto contract is taken to exist by virtue of the employment relationship. Terms of such a contract may include obligations and rights outlined in an employee handbook.
